End User License Agreement (EULA)
This End User License Agreement (EULA) is made between David Rankin of Ashland,Ky. 41101-2023 (VENDOR) and anyone (USER) who installs or uses this software (SOFTWARE). By clicking the "Accept License" and "Submit" buttons USER agrees that EULA is accepted including all terms and conditions set forth below. If USER does not agree to the terms and conditions of this EULA, then DO NOT INSTALL THE SOFTWARE.

Terms and Conditions
Term Of Agreement
The term of this agreement shall begin with USER acceptance of this EULA and shall continue unless USER license is revoked by VENDOR.

Ownership of Software
VENDOR is sole owner of SOFTWARE and does not sell, transfer or convey ownership of any kind to USER, but rather extends to USER license to use the SOFTWARE.

Grant of Software License
VENDOR grants a single-user, non-exclusive and non-transferable license to USER to use the SOFTWARE on a single computer. USER is not allowed to distribute, rent, lease, sub lease sell, or license SOFTWARE. Further USER is not allowed to place SOFTWARE on a computer network of any kind.

Software Copies
User is granted permission to make a single copy of SOFTWARE for archival (backup) purposes.

Authorized Use
USER shall prevent anyone who has not been granted license by VENDOR to SOFTWARE from access to the SOFTWARE.

Installing and Uninstalling Software
USER shall have responsibility to install and uninstall SOFTWARE..

No Warranty
USER accepts SOFTWARE "AS IS " without warranty of any kind. Further VENDOR does not represent or warrant SOFTWARE as having "Suitability of Purpose" of any kind.

Vendor Limitation of Liability
USER agrees that the maximum liability of VENDOR at any time shall be a full refund of any money paid by USER to VENDOR. Further USER agrees that VENDOR has no liability for affect to SOFTWARE caused by third parties, such as updates of the computer operating system or Java programing language.

Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Kentucky. USER agrees that any legal action applicable to SOFTWARE or this EULA shall be initiated and pursued in the courts of Boyd County,Ky. In the event of litigation each party agrees to pay its own litigation expense.
