License Agreement

Warning. The document below is a License Agreement (further referred to as "Agreement"). Please read the document attentively. Installing or using the software (further referred to as "Software") specified in this agreement means that you have read and agree to the terms and conditions of the present agreement. If you do not, you should:

(1) Immediately stop using the Software,
(2) Terminate all copies of the Software, including copies on your hard drive and the archive copies,
(3) Follow the instruction of the manufacturer of the Software.


LICENSE TRANSFER. Keyboard Maniac (TM) grants you the following non-exclusive and non-negotiable license:

a. Using the license.

Individual use. The individual license entitles you to use the Software on one computer, not connected to a computer network. Multiple users. The multi-user license gives you the right to install the Software on several computers or a server and use it in a computer network. To do so, you have to purchase a multi-user license with a specified number of users. It is forbidden to separate the components of the Software and use them on different computers. It is forbidden to distribute the Software. The Software can be loaded to the memory of the computer (RAM) for subsequent use.

b. Storing. Copying the software to a memory unit for storage is permitted.

c. Copying. You can create archive copies containing links to the Software copyrights and an instruction that this copy was created for archiving purposes only.

d. Reservation of rights. Keyboard Maniac (TM) retains all the rights that are not explicitly articulated in the present License Agreement.

e. Freely distributed software. This Software is not freely distributable. If you are using an Internet version, then your Software is an "evaluation version". Therefore, you can use the Software during the specified evaluation period. If you want to continue using the Software, you must register it by making a payment on our web site (www.keyboardmaniac.com). If you decide not to register the Software at the end of the evaluation period, you must remove the Software from all computers where it was installed as an evaluation version. An "evaluation version" can be transformed into a registered version by making a payment on our web site.

f. Violation of the License Agreement. Keyboard Maniac (TM) retains the right to cancel the validity of the unblocking key when the License Agreement is violated or there is a suspicion of its violation.

BACKUP COPIES. You can create a reasonable number of backup copies of the Software for the purposes of replacing the damaged versions of the Software.

Ownership and copyright. The Software is the property of Keyboard Maniac (TM) and its licensors. Keyboard Maniac (TM) and its licensors reserve all copyrights and rights to patents, trademarks and information comprising a commercial secret and all other ownership rights relating to the Software. Except for the cases specified in the present Agreement, you do not have the right to copy, reproduce, modify, decompile, disassemble, change or restore the algorithms used the Software or create derivative products based on this Software. All rights not specifically granted in the present Agreement are protected. Each copy of the Software created as per the conditions provided in the present Agreement, should contain copyright information, ownership information and other warnings found in the original copy of the Software.

LIMITATION OF TRANSFER RIGHTS. This license is personal; therefore neither your rights, nor any copies of the Software can be sold, redirected, transferred, distributed or sublicensed to any user or mass media (including electronic mass media) without a prior written agreement with Keyboard Maniac (TM). Any distribution of the Software resulting in a violation of this agreement is illegal and void, and will automatically terminate your rights to own and use the Software.

UPDATED VERSIONS. Keyboard Maniac (TM) can release updated versions of the Software at its own discretion. You can receive such versions of the Software from Keyboard Maniac (TM) on conditions discussed by Keyboard Maniac (TM) and you. It is assumed that the updated versions of the Software are more precise and efficient. You confirm that you are responsible for downloading and installing the updated versions of the Software.

Software backup. You can obtain the Software in several ways (for instance, by downloading it from the Internet and on a CD). You can use only one copy of the Software on your computer. Installing the software on another computer is prohibited. Renting and other forms of transfer of the Software to other users is prohibited.

LIMITED WARRANTY. Keyboard Maniac (TM) guarantees that the Software will function in all significant respects and according to the during the period of sixty (60) days from the moment you receive it. Keyboard Maniac (TM) DOES NOT GUARANTEE THAT THE SOFTWARE WILL WORK FAULTLESSLY AND IS COMPLETELY ERROR-FREE. THE ABOVE-MENTIONED GUARANTEE IS THE ONLY GUARANTEE REPLACING ALL OTHER GUARANTEES, DIRECT OR INDIRECT, INCLUDING THE INDIRECT GUARANTEE OF SALABILITY AND SUITABILITY FOR A SPECIFIC PURPOSE. As the legislation enacted in a number of jurisdictions prohibits any limitations or denial of responsibility for collateral or consequential damages, the clause above may not be applicable to you.

LIMITATION OF LIABILITY. UNDER NO CIRCUIMSTANCES SHALL Keyboard Maniac (TM) OR ITS LICENSORS BE RESPONSIBLE FOR DIRECT, COLLATERAL OR COONSEQUENTAL DAMAGES, INCLUDING LOSS OF PROFIT, INFORMATION OR ACTIVITY INTERRUPTS RESULTING FROM A SOFTWARE DEFECT, EVEN IF Keyboard Maniac (TM) OR ITS LICENSORS WERE AWARE IF A POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUIMSTANCES SHALL Keyboard Maniac (TM) BE LIABLE UNDER THIS AGREEMENT IN THE AMOUNT EXCEEDING THE ACTUAL PRICE OF THE PRODUCT. THIS RESTRICTION WILL BE APPLICABLE EVEN IF THE AFOREMENTIONED GUARANTEE PROVISION DOES NOT FULFILL ITS PRIMARY TASK. As the legislation enacted in a number of jurisdictions prohibits any limitations or denial of responsibility for collateral or consequential damages, the clause above may not be applicable to you.

RESTRICTIONS BY US GOVERNMENT AGENCIES. The Software and all written materials are provided on the basis of LIMITED RIGHTS. Using, copying and publishing the materials by US government agencies fall under the limitations stated in directive DFAR252.227-7013 with subsequent amendments and additions, as well as in corresponding documents adopted instead. Using the materials by US government agencies implies the recognition of Keyboard Maniac (TM) ownership rights.

APPLICABLE LAWS AND GENERAL PROVISIONS. The present agreement is regulated by the laws of the state of Washington, excluding the application of the norms of interstate laws. If any of the provisions of this Agreement is held invalid, the present Agreement remains in force. You agree that the Software will not be transferred abroad or used in violation of legal norms and normative acts regulating exports from the USA. The present agreement will be dissolved if you refuse to adhere by the Agreement. The present Agreement can only be changed in the written form over the signature of an official representative of Keyboard Maniac (TM).

SOFTWARE LICENSE Keyboard Maniac (TM) reserves the right to make amendments to some clauses of the present license agreement without prior notification. The current version of the license agreement is available at www.keyboardmaniac.com
