Acknowledgement: If you do not accept the terms of this User’s License Agreement, you are required to immediately remove this software from your computer. Software License: Grant of License: This Agreement describes your general license rights to install and use this software program. The license rights described are subject to all of the terms and conditions set forth in this Agreement. General License Grant to Install and Use: Except as otherwise expressly provided in this Agreement, you may only install and use one (1) copy of this software program on any one (1) computer. This software program may not be installed, accessed, displayed, run, shared or used concurrently on or from different computers, including workstations and terminals. Intellectual Property Laws and Treaties: This software program is protected by all intellectual property laws and treaties. This software program is licensed and is not sold. Reservation of Rights: QuitSmoking-QuitSmoking.com and its suppliers reserve all rights not expressly granted to you in this Agreement. Unauthorized Copies: It is illegal to make unauthorized copies of this software program. Some areas may have local laws that may provide you additional back-up rights. Reverse Engineering, Decompilation and Disassembly: You may not reverse engineer, decompile, or disassemble this software program, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. Software Product Transfer: You may permanently transfer all of your rights under this Agreement only as part of a sale or transfer of your computer, provided that the recipient agrees to the terms of this Agreement. Termination of License: Without prejudice to any other rights, QuitSmoking-QuitSmoking.com may terminate your rights under this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you will be required to destroy all copies of this software program in your possession. Trademarks: This Agreement does not grant you any rights in connection with any trademarks or service marks of QuitSmoking-QuitSmoking.com or its suppliers. Intellectual Property Rights: All title and intellectual property rights in and to this software program, including the accompanying printed materials, and any copies of this software program, are owned by QuitSmoking-QuitSmoking.com, or its suppliers. Use of any on-line services which may be accessed through this software may be governed by the respective terms of use relating to such services. If this software program contains documentation that is provided only in electronic form, you may print one copy of such electronic documentation. All rights not specifically granted under this Agreement are reserved by QuitSmoking-QuitSmoking.com and its suppliers. Product Support: Product support for this software program is provided by QuitSmoking-QuitSmoking.com or its suppliers. If support is not available by the supplier of this software, please use the support email that is provided on QuitSmoking-QuitSmoking.com`s website (www.QuitSmoking-QuitSmoking.com/contact.html). Export Restrictions: You agree and acknowledge that this software program is subject to United States export jurisdiction. You also agree to comply with all applicable international and national laws that apply to this software, including United States Export Administration Regulations. Additional Provisions: For limited warranties, limitation of liability, and other special provisions, please refer to the additional provisions provided below and/or with the software product. Such limited warranties, limitation of liability and special provisions are an integral part of this Agreement. Warranty and Special Provisions: Limited Warranty: QuitSmoking-QuitSmoking.com warrants that this software program will perform for a period of ninety (90) days from the date of receipt. Some states/jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. Customer Remedies: QuitSmoking-QuitSmoking.com and its suppliers` entire liability and your exclusive remedy shall be either (a) return of the price paid, or (b) replacement of the software program that does not meet the Limited Warranty. This Limited Warranty is void if failure of this software program has resulted from accident, abuse, or misapplication. Any software replacement will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. No Other Warranties: To the maximum extent permitted by applicable law, QuitSmoking-QuitSmoking.com and its suppliers disclaim all other warranties, either express or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, with regard to this software program and any accompanying written materials. This limited warranty gives you specific legal rights. You may have others which vary from state/jurisdiction to state/jurisdiction. No Liability for Consequential Damages: To the maximum extent permitted by applicable law, in no event shall QuitSmoking-QuitSmoking.com or its suppliers be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of personal income, loss of personal time, loss of personal information, loss of business information, loss of business profits or any other pecuniary loss) arising out of the use of or inability to use this product, even if QuitSmoking-QuitSmoking.com or its suppliers has advised of the possibility of such damages. In any case, QuitSmoking-QuitSmoking.com and its suppliers` entire liability under any provision of this agreement shall be limited to the amount actually paid by you for this software program. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
