Software License agreement and disclaimer of warranty

XML Marker version 1.1, November 2004
IMPORTANT-READ CAREFULLY: This is an agreement between you, (either an individual or a single entity), and Yigal Irani (the author) for the software product identified above (hereinafter the "Software"). By installing or using the software, you agree to become bound by the terms of this agreement. If you do not agree to the terms of this Agreement, you are not authorized to use the software.

This software protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The software is licensed, not sold.

IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THIS SOFTWARE. PROMPTLY REMOVE IT FROM YOUR COMPUTER.

Copyright.
The author retains the copyright, title and ownership of the software and the written materials regardless of the form or media in or on which the original and other copies may exist.

Grant of license
Subject to the terms and condition outlined below, the author, as Licensor, grants to you, the Licensee, a non-exclusive right to use of the software.


Freeware
This program is Freeware. You may use it for any purpose and also distribute it in any medium, provided that the program is not modified in any way


Termination.
The author may terminate the rights that you were granted if you fail to comply with the terms and conditions of this agreement. In such event, you must stop using the software and delete all the copies that you have.

Reservation of Rights.
The author reserves all the rights that are not expressly granted.

Transfers.
You may copy the installation program of the software provided it is copied without modification. All other copying is not permitted (for example, portions of the documentation or executable files).


Limitations on Reverse Engineering, modification, decompilation, Disassembly.
You may not reverse engineer, modify, decompile, or disassemble the software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Disclaimer of warranty.
THIS SOFTWARE AND ACCOMPANYING DOCUMENTATION (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, FURTHER, THE AUTHOR DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE OR DOCUMENTATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. IF THE SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE, YOU, AND NOT THE AUTHOR OR ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

THE AUTHOR DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, THAT IS MADE BY THE AUTHOR, ON THIS PRODUCT. Should any other warranties be found to exist, such warranties shall be limited in duration to ninety (90) days following the date of delivery to you. In no event will the author liability for any damages to you or any other person exceed the amount paid for the license to use the SOFTWARE.

This License shall be governed by the laws of the State of New York.
